Agreement to Terms

By accessing or using LinkCheck ("Service"), operated by LinkCheck ("we," "us," or "our") at linkcheck.live, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

These Terms constitute a legally binding agreement between you and LinkCheck.

Description of Service

LinkCheck is a web-based broken link scanning service that helps website owners identify broken links and 404 errors on their websites. The Service scans websites you submit and provides reports on the status of links found on those pages.

Features and functionality may vary based on your subscription plan. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Scan websites you do not own or have authorization to scan
• Use the Service to overwhelm, attack, or harm any website or server
• Attempt to bypass any rate limits or usage restrictions
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated means to access the Service except through our provided API
• Resell, redistribute, or sublicense the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service

Subscription and Payment

Pricing and Plans

We offer free and paid subscription plans. Current pricing is available on ourpricing page. All prices are in USD unless otherwise stated.

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or as specified). You authorize us to charge your payment method on file for all applicable fees.

Refunds

Subscription fees are non-refundable except as required by law. Single scan purchases are non-refundable once the scan has been initiated.

Cancellation

You may cancel your subscription at any time through your dashboard. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds or credits will be provided for partial billing periods.

Intellectual Property

The Service and its original content, features, and functionality are owned by LinkCheck and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, graphics, and logos may not be used without our prior written consent. You retain ownership of any data you submit to the Service.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. This license does not include:

• Resale or commercial redistribution of the Service
• Modification or derivative works based on the Service
• Use of data mining, robots, or similar data gathering tools
• Any use that competes with or harms the Service

Data and Privacy

Your use of the Service is also governed by ourPrivacy Policy, which describes how we collect, use, and protect your information.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process and store this data as necessary to provide the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

• The Service will function uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

Limitation of Liability

To the maximum extent permitted by law, LinkCheck and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your data

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless LinkCheck and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Any claim that your use of the Service caused damage to a third party

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and associated data
• Provisions that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue formal resolution.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
